1. Introduction

Welcome to Diary Keeper – Private Journal ("the App"), developed and published by Saranjith Krishnan ("we", "our", "us"). By downloading, installing or using the App you agree to these Terms and Conditions ("Terms"). If you do not agree with any part of these Terms, do not use the App.

2. Use of the App

2.1 Eligibility. You must be at least 13 years old, or the minimum age required in your country, to use the App.

2.2 Licence. We grant you a limited, non-exclusive, non-transferable, revocable licence to use the App on Apple devices you own or control, for personal, non-commercial purposes, in line with the App Store Terms of Service.

3.1 Ownership. You own everything you write or add in the App ("Diary Content"). We claim no rights over it.

3.2 Where it lives. Diary Content is stored on your device and, if you enable iCloud sync, in your own iCloud account. We do not receive, host or have access to it. You are responsible for keeping backups; the App includes export and backup features for this purpose.

3.3 Responsibility. You are solely responsible for Diary Content and for making sure it does not violate any law or third-party rights.

4. Purchases and ads

4.1 Free version. The App is free to download and use. The free version displays advertisements served by Google AdMob.

4.2 Remove Ads. You may buy a one-time in-app purchase that removes ads. Purchases are made through and governed by Apple's App Store; prices are shown in the App Store in your local currency. Refunds are handled by Apple under its policies. You can restore the purchase on any device signed into the same Apple ID using "Restore Purchases" in the App.

4.3 No subscription. The App does not offer or charge subscriptions.

5. Privacy

Our Privacy Policy explains what limited information the App handles and how. It forms part of these Terms.

6. Intellectual property

The App, including its design, code, artwork, themes, writing prompts, templates, quotes and trademarks, is owned by Saranjith Krishnan or its licensors and is protected by applicable intellectual property laws. You may not reproduce, distribute, modify, create derivative works of, publicly display or commercially exploit any part of the App without our prior written consent. This does not restrict your rights over your own Diary Content.

7. Third-party services

The App relies on Apple (App Store, iCloud, Face ID, Touch ID), Google AdMob (advertising) and Mixpanel (anonymous analytics). Those services are governed by their own terms and privacy policies, and we are not responsible for their availability or conduct.

8. Disclaimers

8.1 No warranty. The App is provided "as is" and "as available" without warranties of any kind, express or implied. We do not warrant that the App will be uninterrupted, error-free or free of harmful components, or that iCloud sync will never fail.

8.2 Not a medical service. Mood tracking, prompts and templates are for personal reflection only and are not medical, psychological or professional advice.

8.3 Limitation of liability. To the maximum extent permitted by law, we are not liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of data, profits, goodwill or other intangible losses, arising from your use of or inability to use the App, including loss of Diary Content. Our total liability for any claim relating to the App is limited to the amount you paid us for it in the twelve months before the claim, if any.

9. Termination

You may stop using the App at any time by deleting it. We may suspend or end your licence if you breach these Terms. Sections 3, 6, 8 and 10 survive termination.

10. Governing law

These Terms are governed by the laws of India, without regard to conflict-of-law rules. Nothing in these Terms limits any consumer rights you have under the mandatory laws of your country.

11. Changes to these Terms

We may update these Terms from time to time. We will post the new version on this page and update the date at the top; material changes will also be noted in the App's release notes. Continued use of the App after changes take effect means you accept the updated Terms.
